1. DEFINITIONS
1.1. Seller – Lumis Motors, MB Lumis Foto, legal entity code 305950109, registered in Lithuania.
1.2. Online Store – the electronic commerce platform operated by the Seller at www.lumismotors.com.
1.3. Agreement – a distance purchase and sale agreement concluded between the Buyer and the Seller upon confirmation of an order in the Online Store, together with these Terms and Conditions and any later amendments.
1.4. Buyer / Customer – a natural person or legal entity purchasing goods from the Online Store in accordance with these Terms.
1.5. Third Country – any country that is not a member of the European Union or the European Economic Area.
1.6. Terms – these Terms and Conditions governing the purchase, payment, delivery, return, and liability related to goods sold through the Online Store.
2. GENERAL PROVISIONS
2.1. The Seller undertakes to sell and deliver goods to the Buyer, and the Buyer undertakes to accept the goods, pay the agreed price, cover delivery costs, and pay any applicable customs duties in accordance with these Terms.
2.2. Purchases may be made by:
individuals aged 18 or older;
minors aged 14–18 with consent of a parent or legal guardian;
legal entities.
2.3. The Online Store operates from Lithuania, and these Terms are governed by applicable national and EU law.
2.4. By placing an order, the Buyer confirms that they have read and agree to these Terms.
3. BUYER’S RIGHTS
3.1. The Buyer has the right to purchase goods in accordance with these Terms.
3.2. Consumer Buyers have the right to withdraw from the Agreement within 14 calendar days of receiving the goods, except in cases where withdrawal is excluded by law.
4. BUYER’S OBLIGATIONS
4.1. The Buyer must pay for the ordered goods and accept delivery.
4.2. The Buyer is responsible for maintaining the confidentiality of login details and account access.
4.3. The Buyer must ensure that all provided personal and delivery information is accurate and up to date.
4.4. The Buyer undertakes to comply with these Terms and applicable legal requirements.
4.5. Buyers located in Third Countries are solely responsible for customs duties, import taxes, and related procedures.
5. SELLER’S RIGHTS
5.1. The Seller may impose minimum order values or restrict access to the Online Store in case of violations of these Terms.
5.2. The Seller may temporarily or permanently suspend Online Store operations for technical or business reasons.
5.3. The Seller reserves the right to cancel an order if payment is not received within 5 business days.
6. SELLER’S OBLIGATIONS
6.1. The Seller undertakes to provide access to the Online Store and deliver goods to the address specified by the Buyer.
6.2. If delivery of ordered goods is not possible, the Seller shall inform the Buyer and offer an alternative solution or a refund.
7. ORDERING AND AGREEMENT CONCLUSION
7.1. Buyers may place orders as registered or unregistered users.
7.2. The Agreement is concluded at the moment the Seller confirms the Buyer’s order.
7.3. All Agreements are stored electronically in the Seller’s system.
8. PRICES AND PAYMENTS
8.1. Prices are indicated in EURO and exclude VAT and delivery costs unless stated otherwise.
8.2. Payments may be made by bank transfer, credit/debit card, Apple Pay, Google Pay, or PayPal.
8.3. The Seller is not responsible for errors occurring during payment processing by third-party providers.
8.4. VAT exemptions apply to EU VAT-registered companies when legal conditions are met and goods are shipped to the registered address.
8.5. Orders are processed only after full payment has been received.
9. DELIVERY
9.1. Goods are delivered worldwide to the address provided by the Buyer.
9.2. Delivery is performed by the Seller or authorized courier services.
9.3. If ordered goods are temporarily unavailable, the Buyer will be informed of revised delivery terms.
9.4. The Seller is not liable for delivery delays caused by Buyer fault, third-party carriers, customs procedures, or force majeure.
9.5. Upon delivery, the Buyer must inspect the shipment. Visible damage must be documented and reported to info@lumismotors.com without delay.
9.6. Shipping costs depend on destination and shipment parameters.
9.7. For deliveries to Third Countries, all customs-related obligations rest with the Buyer.
10. PRODUCT QUALITY AND WARRANTY
10.1. Product characteristics are described in product listings at www.lumismotors.com.
10.2. The Seller is not responsible for visual differences caused by the Buyer’s display settings.
10.3. Information regarding product warranties may be requested at info@lumismotors.com.
10.4. Where no additional warranty is provided, statutory warranty rights apply.
10.5. Products subject to a usability period are sold in compliance with legal requirements.
11. RETURNS DUE TO DEFECTS
11.1. Defective goods are handled in accordance with Lithuanian retail trade regulations.
11.2. Returned defective goods must:
be clean and complete;
match the original configuration;
be accompanied by proof of purchase.
11.3. Return shipping costs are covered by the Seller only if a defect is confirmed.
12. RIGHT OF WITHDRAWAL (CONSUMERS)
12.1. Consumer Buyers may withdraw from the Agreement within 14 days without giving a reason, in accordance with EU consumer protection law.
12.2. The right of withdrawal does not apply to:
custom-made or personalized goods;
sealed goods unsealed after delivery for health or hygiene reasons;
digital products once delivery or download has begun.
12.3. Withdrawal requests must be submitted to info@lumismotors.com.
12.4. Returned goods must be unused, undamaged, and in original packaging.
12.5. Refunds are issued within 14 days using the original payment method, subject to receipt of returned goods.
12.6. Return shipping costs are borne by the Buyer.
13. LIABILITY
13.1. The Buyer is responsible for the accuracy of provided information.
13.2. The Seller is not liable for consequences arising from Buyer misuse, incorrect installation, or failure to follow instructions.
13.3. The Seller is not responsible for customs delays or charges in Third Countries.
13.4. Liability is limited to direct damages to the extent permitted by law.
13. LIABILITY
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
14. FINAL PROVISIONS
14.1. The Seller may amend these Terms at any time. Updated versions are published in the Online Store.
14.2. Disputes shall be resolved amicably; failing that, in courts of Lithuania at the Seller’s registered location.
